Minutes of Meeting of February 16, 2005
Town Hall Hearing Room

Chair O’Connell called the meeting to order at 7:10 p.m. and opened the public hearing.

By-Law Revisions
First Chair O’Connell wanted to discuss the need for the Wellhead Protection District.  He had spoken to DEP’s Mike Quink, who said that the Interim Wellhead Protection Area (IWPA) covers wells pumping under 100,000 gallons per day and that no zoning rules are required.  O’Connell said that since Wellfleet does not have a Zone 2, the Overlay Articles were not necessary.  However, PB and members of the audience, Helen Miranda Wilson from the BOS/Water Commissioners and Anne White and Richard Willecke from the Board of Health, agreed to proceed with the Overlay District amendments.

From the floor, Helen Miranda Wilson addressed Article B, section 9.1.4.5 “Exemptions.”  She wanted to see the Water Commissioners added to the list of boards to be notified of applications to the ZBA for special permit exemption requests.  After a discussion of this, Gerald Parent made a motion to include the Water Commissioners.  Ben Gitlow seconded the motion.
The Board voted 5-0 to add the Water Commissioners to section 9.1.4.5.

Parent suggested that time frames be added to this section.  Gitlow moved that a 7-day notification period and a 30-day response period be added to section 9.1.4.5.  Harriet Miller seconded the motion. After discussion the 30-day period was amended to 45 days, which Willecke said would work better for the BOH.
The motion to specify time frames carried 5-0.

Wilson suggested an amendment to Prohibited Use Regulations section 9.1.4.2, item # 10.  This generated much discussion about spraying and use of pesticides until Willecke pointed out that item #10 only dealt with storage issues.  Item #11 covered usage.  

O’Connell said the Board could vote on amendments to the Articles after the public hearing and went on to Article C, Service Trades.  This involved a shift in the grid and the National Park Service was okay with this.

Article E, section 6.2 Accessory Buildings needed a little reworking on shed setbacks, but was otherwise okay.

Chair O’Connell closed the public hearing at approximately 8:45 p.m. and asked the Board to vote on the recommended Articles for Town Meeting.
Parent made a motion to approve the amended Article B. Pickard seconded.
All voted in favor of the amended Article B 5- 0.

Harriet Miller moved to approve Article C; O’Connell seconded the motion.
The Board voted to approve Article C on Service Trades 5- 0.

Parent motioned to approve Article E with the changes; Miller seconded.
The Board voted to approve Article E 5- 0.

Other Business
Ben Gitlow said the Charter Review Commission wanted any suggested changes from the Planning Board regarding the Charter description of PB.  The Board agreed to draft changes in the existing document and discuss possible modifications at the next meeting.

Minutes
O’Connell moved to approve the January 19, 2005 minutes; Gitlow  seconded; the Board approved the minutes 3-0-2 (Pickard and Parent abstaining).

Mail
O’Connell called everyone’s attention to the conference in Worcester, March 19, Advanced Tools and Procedures for Planning and Zoning.

W.H.A.T.
(O’Connell advised Parent that the next topic was WHAT.  Parent recused himself and left the meeting.)
About 45 people attended the ZBA meeting for W.H.A.T., O’Connell said.  He wanted the Board to be prepared for a large attendance when the theater referral comes to PB.

Adjournment
Gitlow moved; Miller seconded; the Board unanimously voted to adjourn 4-0.  The Board adjourned at 9:10 p.m.
